ΠΑΡΑΔΟΣΗ ΚΑΙ ΠΑΡΑΛΑΒΗ
Ο Μισθωτής παραλαμβάνει το αυτοκίνητο σε καλή κατάσταση, οποιαδήποτε παράπονο για την κατάσταση του αυτοκινήτου θα πρέπει να γίνεται κατά την παράδοση του. Ο Μισθωτής υποχρεούται να επιστρέψει στην Key Cars το αυτοκίνητο και όλα τα έντυπα, εργαλεία και εξαρτήματα που το συνοδεύουν, και στον τόπο και χρόνο που έχει καθοριστεί. Σε αντίθετη περίπτωση και μετά την πάροδο του συμφωνημένου χρόνου επιστροφής ο Μισθωτής θα έχει την υποχρέωση να καταβάλλει στην Key Cars την κανονική χρέωση για αποζημίωση χρήσεως καθώς και αποζημίωση για κάθε θετική και αποθετική ζημία της. Η Key Cars διατηρεί το δικαίωμα να επανακτήσει στην κατοχή της το αυτοκίνητο οποιαδήποτε στιγμή χωρίς προειδοποίηση και χωρίς τη συγκατάθεση του Μισθωτή, αλλά με έξοδα αυτού εάν και εφ’ όσον αυτό χρησιμοποιήθηκε ή χρησιμοποιείται κατά παράβαση των όρων και των προϋποθέσεων της Key Cars. Κατά την άφιξη του ο μισθωτής-οδηγός του αυτοκινήτου θα πρέπει να έχει μαζί του τα πρωτότυπα παρακάτω έγγραφα:
Την Άδεια οδηγήσης
Την Αστυνομική του ταυτότητα
Έγκυρη πιστωτική κάρτα (Visa or Mastercard)
ΚΛΟΠΗ- ΖΗΜΙΕΣ
Σε περίπτωση κλοπής, απώλειας ή ζημίας του Αυτοκινήτου ή τρίτων (συμπεριλαμβανομένων και των συνεπιβατών του) ο Μισθωτής έχει την υποχρέωση να αποζημιώσει την Key Cars καθώς και κάθε τρίτον.
Ειδικότερα:
α) Ο Μισθωτής ευθύνεται για όλες τις ζημιές που έχει προκαλέσει στο Αυτοκίνητο ή σε τρίτους εάν έχει παραβεί τους όρους χρήσης του αυτοκινήτου ή οδήγησε αυτό κατά τρόπο παράνομο ή αντίθετο από όσα προβλέπονται από τον Κώδικα Οδικής Κυκλοφορίας,
β) Ο Μισθωτής ευθύνεται για την μερική ή ολική κλοπή ή απώλεια του Αυτοκινήτου, εκτός εάν η Key Cars έχει απαλλάξει τον Μισθωτή από την ευθύνη για ολική κλοπή ή απώλεια Αυτοκινήτου. Η απαλλαγή αυτή ισχύει εφόσον ο Μισθωτής έχει ήδη αποδεχτεί κατά την έναρξη της μίσθωσης την ημερήσια χρέωση και τους όρους για την “Κάλυψη Κλοπής” (ΤΡ) του Αυτοκινήτου και την “Απαλλαγή Ευθύνης” (CDW) και εφόσον ο Μισθωτής είχε λάβει όλες τις προφυλάξεις προς αποτροπή της ολικής κλοπής ή απώλειας του. Ρητά συμφωνείται ότι η κλοπή ή απώλεια τμημάτων, εξαρτημάτων ή και εξοπλισμού (μερική κλοπή) του Αυτοκινήτου δεν καλύπτεται από την παραπάνω αποδοχή “Κάλυψης Κλοπής” (ΤΡ) και ”Απαλλαγής Ευθύνης” (CDW).
γ) Ο Μισθωτής ευθύνεται για κάθε ζημία ή απώλεια του Αυτοκινήτου συνέπεια σύγκρουσης ή πυρκαγιάς, εκτός εάν ο Μισθωτής έχει αποδεχτεί τον όρο “Απαλλαγής Ευθύνης” (CDW) και καταβάλλοντας την αντίστοιχη ημερήσια χρέωση. Η παραπάνω αποδοχή “Απαλλαγής Ευθύνης” (CDW) δεν απαλλάσσει τον Μισθωτή, εάν το αυτοκίνητο δεν χρησιμοποιήθηκε σύμφωνα με τους όρους και τις προϋποθέσεις της Key Cars. Ακόμα και στην περίπτωση που ο Μισθωτής έχει αποδεχτεί ”Απαλλαγής Ευθύνης” υπάρχει ελάχιστη χρέωση για την αποκατάσταση του κόστους της ζημιάς, εκτός εάν ο Μισθωτής έχει αποδεχτεί την “Πλήρη Απαλλαγή Ευθύνης” (FDW), Μερική Απαλλαγή Ευθύνης (CDW) ή ‘‘Καθρέπτες-Τζάμια-Λάστιχα’’(LDW).
Ζημιές που βαρύνουν εξ’ολοκλήρου τον μισθωτή:
Το κάτω μέρος του αυτοκινήτου και μαρσπιέ.
Ελαστικά,τροχοί,καθρέπτες και τζάμια.
Κατά την διάρκεια φόρτωσης, εκφόρτωσης ή μεταφοράς του αυτοκινήτου σε πλοία ή τρένα ή άλλα μεταφορικά μέσα χωρίς την προηγούμενη εγγραφή συγκατάθεση της Key Cars.
ΧΡΕΩΣΕΙΣ
Ο Μισθωτής θα καταβάλλει στην Key Cars στο σύνολο της μίσθωσης τα παρακάτω ποσά:
α) το ημερήσιο μίσθωμα του αυτοκινήτου καθώς και χρεώσεις που αντιστοιχούν σε διανυθέν χιλιόμετρα.
β) Όλες οι χρεώσεις που αφορούν την συμπλήρωση του αυτοκινήτου με καύσιμα, την “Κάλυψη Κλοπής” (ΤΡ), την “Απαλλαγή Ευθύνης” (CDW), την “Πλήρη Απαλλαγή Ευθύνης” (FDW), ‘‘Καθρέπτες-Τζάμια-Λάστιχα’’(LWS).
γ) Φόρους, τέλη και άλλα έξοδα που αφορούν την μίσθωση του αυτοκινήτου.
δ) Τυχόν έξοδα της Key Cars, συμπεριλαμβανομένων δικηγορικών αμοιβών και τόκων υπερημερίας, λόγω εκπρόθεσμης πληρωμής οποιονδήποτε ποσών αυτής της μίσθωσης ή επανάκτηση της κατοχής και χρήσης του αυτοκινήτου από την Key Cars,
ε) Τυχόν χρηματικές ποινές, πρόστιμα, δικαστικά και άλλα έξοδα που επιβλήθηκαν ή τυχόν θα επιβληθούν στην Key Cars λόγω παραβάσεων κατά την χρήση του αυτοκινήτου από τον Μισθωτή.
στ) Οποιοδήποτε ποσό που απαιτείται για την αντικατάσταση ή επισκευή ελαστικών ή τροχών που καταστράφηκαν ή κάθε χρηματικό ποσό για αποκατάσταση ζημιάς στο κάτω μέρος του αυτοκινήτου για επισκευή οποιασδήποτε άλλης ζημίας καθώς και για αποζημίωση λόγω απώλειας του αυτοκινήτου, εκτός εάν έχουν γίνει αποδεκτές οι σχετικές απαλλαγές και έχουν τηρηθεί οι όροι αυτών.
ζ) Την πρόσθετη επιβάρυνση για την παραλαβή ή παράδοση του Αυτοκινήτου καθώς και την επιστροφή αυτού σε σημείο διαφορετικό από το καθορισμένο.
η) Οι παραδόσεις και παραλαβές εκτός ωραρίου (22:00-07:00) υπόκεινται σε έξτρα χρέωση των 20 ευρώ.
θ) Την πρόσθετη επιβάρυνση για επασφάλιστρο οδηγού λόγω ηλικίας.
ι) Οι εκπτώσεις που τυχών παρέχονται από την Key Cars δεν ισχύουν εάν ο λογαριασμός δεν εξοφληθεί εμπρόθεσμα.
κ) Όλες οι χρεώσεις υπόκεινται σε τελικό έλεγχο.
ΠΑΡΑΤΑΣΗ ΤΗΣ ΜΙΣΘΩΣΗΣ
Εάν ο Μισθωτής επιθυμεί την παράταση της μίσθωσης του αυτοκινήτου, υποχρεούται να ειδοποιήσει εγγράφως την Key Cars σαράντα οκτώ (48) ώρες τουλάχιστον πριν την λήξη της μίσθωσης για να λάβει την σχετική έγγραφη έγκριση. Εάν παραλείψει να το κάνει υπέχει αστική και ποινική ευθύνη για παράνομη χρήση και κατοχή του αυτοκινήτου.
ΕΥΘΥΝΗ
Ο Μισθωτής ρητά συμφωνεί ότι η Key Cars δεν ευθύνεται για καμιά θετική ή αποθετική ζημία που υπέστη ο Μισθωτής κατά τη διάρκεια της μίσθωσης και ουδεμία αξίωση μπορεί να εγερθεί εναντίον της Key Cars για ανωτέρα αιτία.
ΑΤΥΧΗΜΑΤΑ
Σε περίπτωση ατυχήματος ή άλλου περιστατικού (πυρκαγιάς, κλοπής) ο Μισθωτής ή ο πρόσθετος οδηγός, υποχρεούται άμεσα τα παρακάτω:
α) Να μην αναγνωρίσει υπαιτιότητα ή ενοχή και αξιώσεις έναντι τρίτων.
β) Να καταγράψει στοιχεία των αυτόπτων μαρτύρων καθώς και στοιχεία του οδηγού και του αυτοκινήτου με το οποίο συγκρούσθηκε.
γ) Να ειδοποιήσει την αστυνομία προς εξακρίβωση της υπαιτιότητας και περίθαλψη των τυχόν υπαρχόντων τραυματιών.
δ) Να επικοινωνήσει αμέσως τηλεφωνικώς ή με οποιοδήποτε άλλο μέσο με την Key Cars.
ε) Να συλλέξει οποιαδήποτε σχετική πληροφορία από κάθε τρίτο.
στ) Να φωτογραφίσει τον τόπο του ατυχήματος και τα αυτοκίνητα που συμμετείχαν στο ατύχημα εάν αυτό είναι δυνατόν.
ζ) Σε περίπτωση κλοπής ή απώλειας του αυτοκινήτου ο Μισθωτής υποχρεούται να καταγγείλει εγγράφως το γεγονός στην πλησιέστερη αστυνομική αρχή.
η) Να συμπληρώσει και να υπογράψει εντός είκοσι τεσσάρων (24) ωρών δήλωση ατυχήματος/κλοπής στο πλησιέστερο υποκατάστημα Key Cars, όπως και να προσκομίσει οποιαδήποτε σχετικά έγγραφα ή πληροφορίες.
θ) Να καλέσει την οδική βοήθεια καθώς επίσης και την φροντίδα ατυχήματος.
ΑΣΦΑΛΕΙΕΣ
α) Η Key Cars παρέχει στον Μισθωτή και σε κάθε πρόσθετο οδηγό, ασφαλιστική κάλυψη από ασφαλιστικές εταιρείες της επιλογής της με την προϋπόθεση οτι δεν παρέβησαν κανέναν απολύτως όρο της Key Cars. Ειδικότερα:
CDW (Απαλλαγή Ευθύνης)
TP (Κάλυψη κλοπής)
LWS (Καθρέπτες- Τζάμια- Λάστιχα)
FDW (Πλήρη Απαλλαγή Ευθύνης)
β) Οι αποσκευές δεν καλύπτονται ασφαλιστικώς και ο Μισθωτής ευθύνεται για τυχόν απώλεια ή φθορά αντικειμένων που αποτελούν ιδιοκτησία του ή μη. Η Key Cars δεν φέρει καμία ευθύνη για τυχόν απώλεια, φθορά κτλ. αυτών κατά την μίσθωση ή μετά την επιστροφή του αυτοκινήτου στην Key Cars.
ΠΡΟΣΩΠΙΚΑ ΣΤΟΙΧΕΙΑ
Ο Μισθωτής συναινεί στην λεπτομερή καταχώρηση των προσωπικών αυτού στοιχείων σε ηλεκτρονικό υπολογιστή. Ρητά συμφωνείται ότι η Key Cars έχει δικαίωμα να χρησιμοποιεί τα στοιχεία αυτά, όταν ο Μισθωτής κατά την διάρκεια της μίσθωσης κάνει αναληθείς δηλώσεις ή παραβαίνει τους όρους και τις προϋποθέσεις της Key Cars να διαβάζει τα στοιχεία αυτά στις Αρχές της χώρας σε περίπτωση που υπάρχουν υπόνοιες τελέσεως ποινικού ή άλλου αδικήματος.
ΟΡΟΙ ΧΡΗΣΗΣ- ΠΡΟΫΠΟΘΕΣΕΙΣ
Ο Μισθωτής υποχρεούται:
Να διατηρεί το αυτοκίνητο σε καλή κατάσταση, να ελέγχει την μηχανική του κατάσταση την στάθμη των λαδιών, του νερού και την πίεση των ελαστικών.
Κατά τη διάρκεια της μίσθωσης όλοι οι πρόσθετοι οδηγοί ευθύνονται αλληλέγγυα και εις ολόκληρον με τον Μισθωτή. Ομοίως, σε περίπτωση που αντιπρόσωπος υπογράψει το μισθωτήριο, αυτός θα ευθύνεται αλληλέγγυα και εις ολόκληρων με τον αντιπροσωπευόμενο.
Η μεταφορά κατοικίδιων ζώων επιτρέπεται, με ευθύνη του οδηγού ή άλλου εντεταλμένου προσωπικού μεταφορέα, εφόσον:
Είναι τοποθετημένα σε ασφαλές κλουβί μεταφοράς κλειστού τύπου.
Ο ιδιοκτήτης ή κάτοχος του κατοικίδιου ζώου όπως φέρει το ατομικό βιβλιάριο υγείας αυτού.
Το όριο ηλικίας του οδηγού θα πρέπει να είναι από 23 έως 75 ετών.
Να είναι κάτοχος ευρωπαϊκής ή διεθνούς άδειας οδηγήσεως.
Το αυτοκίνητο απαγορεύεται:
Να εξέλθει από τα σύνορα της Ελλάδας.
Να μεταφέρει πρόσωπα ή πράγματα έναντι κομίστρου.
Να ρυμουλκεί ή σύρει αυτοκίνητα ή άλλα αντικείμενα.
Να φορτωθεί σε τρένο ή πλοίο ή άλλο μεταφορικό μέσο χωρίς την προηγούμενη έγγραφη συγκατάθεση της Key Cars.
Να συμμετέχει ή ακολουθεί αγώνες ταχύτητας.
Για υπεκμίσθωση ή παραχώρηση σε τρίτους.
Την τέλεση πράξεων που αντίκειται στους Ελληνικούς Νόμους.
Να είναι ο Μισθωτής ή ο πρόσθετος οδηγός αυτοκινήτου υπό την επήρεια οινοπνεύματος, παραισθησιογόνων, ναρκωτικών, βαρβιτουρικών ή οποιασδήποτε άλλης ουσίας που επηρεάζει την ικανότητα οδήγησης και τις αισθήσεις.
Να μεταφέρει ή μετακινεί βαριές αποσκευές, εύφλεκτα υλικά, ρυπαρά ή δύσοσμα αντικείμενα, ναρκωτικά κτλ.
Οποιαδήποτε επισκευή του αυτοκινήτου από τον Μισθωτή ή άλλον τρίτον χωρίς προηγούμενη έγκριση της Key Cars.
DELIVERY AND RETURN
The Renter receives the vehicle in good condition. Any complaint regarding the condition of the vehicle must be made at the time of delivery. The Renter is obliged to return the vehicle to Key Cars, together with all documents, tools and accessories accompanying it, at the agreed place and time. Otherwise, and after the agreed return time has elapsed, the Renter shall be obliged to pay Key Cars the normal charge as compensation for use, as well as compensation for any direct or consequential loss or damage. Key Cars reserves the right to retake possession of the vehicle at any time without notice and without the Renter’s consent, at the Renter’s expense, if and insofar as the vehicle was used or is being used in breach of Key Cars’ terms and conditions. Upon arrival, the renter-driver of the vehicle must have with them the following original documents:
Driving licence
Identity card / ID
Valid credit card (Visa or Mastercard)
THEFT - DAMAGES
In the event of theft, loss or damage to the Vehicle or to third parties (including fellow passengers), the Renter is obliged to compensate Key Cars as well as any third party.
Specifically:
a) The Renter is liable for all damage caused to the Vehicle or to third parties if the Renter has breached the terms of use of the vehicle or drove it illegally or contrary to the provisions of the Road Traffic Code,
b) The Renter is liable for the partial or total theft or loss of the Vehicle, unless Key Cars has released the Renter from liability for total theft or loss of the Vehicle. This release applies provided that, at the start of the rental, the Renter has already accepted the daily charge and the terms for the Vehicle “Theft Protection” (TP) and “Collision Damage Waiver” (CDW), and provided that the Renter had taken all precautions to prevent total theft or loss. It is expressly agreed that theft or loss of parts, accessories or equipment (partial theft) of the Vehicle is not covered by the above acceptance of “Theft Protection” (TP) and “Collision Damage Waiver” (CDW).
c) The Renter is liable for any damage to or loss of the Vehicle resulting from collision or fire, unless the Renter has accepted the “Collision Damage Waiver” (CDW) term by paying the corresponding daily charge. The above acceptance of “Collision Damage Waiver” (CDW) does not release the Renter if the vehicle was not used in accordance with Key Cars’ terms and conditions. Even where the Renter has accepted “Collision Damage Waiver”, there is a minimum charge for restoration of the damage cost, unless the Renter has accepted the “Full Damage Waiver” (FDW), Partial Damage Waiver (CDW), or “Mirrors-Windows-Tyres” (LDW).
Damage fully borne by the renter:
The underside of the vehicle and side sills.
Tyres, wheels, mirrors and windows.
During loading, unloading or transport of the vehicle on ships, trains or other means of transport without the prior written consent of Key Cars.
CHARGES
The Renter shall pay Key Cars the following amounts for the entire rental period:
a) the daily rental charge for the vehicle, as well as charges corresponding to kilometres travelled.
b) All charges relating to refuelling the vehicle, “Theft Protection” (TP), “Collision Damage Waiver” (CDW), “Full Damage Waiver” (FDW), “Mirrors-Windows-Tyres” (LWS).
c) Taxes, duties and other expenses relating to the rental of the vehicle.
d) Any expenses of Key Cars, including legal fees and default interest, due to late payment of any amounts under this rental or repossession of the vehicle’s possession and use by Key Cars,
e) Any monetary penalties, fines, court costs and other expenses imposed or to be imposed on Key Cars due to violations during the Renter’s use of the vehicle.
f) Any amount required for the replacement or repair of tyres or wheels that were destroyed, or any amount for restoration of damage to the underside of the vehicle, repair of any other damage, as well as compensation for loss of the vehicle, unless the relevant waivers have been accepted and their terms have been observed.
g) The additional charge for pick-up or delivery of the Vehicle, as well as its return to a point different from the agreed one.
h) Deliveries and collections outside business hours (22:00-07:00) are subject to an extra charge of 20 euros.
i) The additional charge for driver age insurance surcharge.
j) Any discounts that may be provided by Key Cars shall not apply if the account is not settled on time.
k) All charges are subject to final verification.
EXTENSION OF THE RENTAL
If the Renter wishes to extend the rental period of the vehicle, the Renter is obliged to notify Key Cars in writing at least forty-eight (48) hours before the end of the rental period in order to obtain the relevant written approval. Failure to do so entails civil and criminal liability for unlawful use and possession of the vehicle.
LIABILITY
The Renter expressly agrees that Key Cars shall not be liable for any direct or consequential damage suffered by the Renter during the rental period, and no claim may be brought against Key Cars due to force majeure.
ACCIDENTS
In the event of an accident or other incident (fire, theft), the Renter or the additional driver is obliged to do the following immediately:
a) Not to acknowledge liability or guilt and not to accept claims against third parties.
b) To record the details of eyewitnesses as well as the details of the driver and the vehicle with which the collision occurred.
c) To notify the police in order to establish liability and provide care to any injured persons.
d) To contact Key Cars immediately by telephone or by any other means.
e) To collect any relevant information from any third party.
f) To photograph the accident scene and the vehicles involved in the accident, if possible.
g) In the event of theft or loss of the vehicle, the Renter must report the incident in writing to the nearest police authority.
h) To complete and sign, within twenty-four (24) hours, an accident/theft declaration at the nearest Key Cars branch, and to provide any relevant documents or information.
i) To call roadside assistance as well as accident care service.
INSURANCE
a) Key Cars provides the Renter and every additional driver with insurance coverage from insurance companies of its choice, on condition that they have not breached any term whatsoever of Key Cars. In particular:
CDW (Collision Damage Waiver)
TP (Theft Protection)
LWS (Mirrors - Windows - Tyres)
FDW (Full Damage Waiver)
b) Luggage is not insured and the Renter is responsible for any loss of or damage to items that are their property or otherwise. Key Cars bears no responsibility for any loss, damage, etc. to such items during the rental or after the vehicle has been returned to Key Cars.
PERSONAL DATA
The Renter consents to the detailed recording of their personal data in a computer system. It is expressly agreed that Key Cars has the right to use such data when, during the rental, the Renter makes false statements or breaches Key Cars’ terms and conditions, and to disclose such data to the authorities of the country in the event that there are suspicions of a criminal or other offence.
TERMS OF USE - CONDITIONS
The Renter is obliged:
To keep the vehicle in good condition, to check its mechanical condition, the oil and water levels, and tyre pressure.
During the rental period all additional drivers are jointly and severally liable with the Renter. Likewise, in the event that an agent signs the rental agreement, that agent shall be jointly and severally liable with the represented person.
The transport of pets is permitted, under the responsibility of the driver or other authorised transport personnel, provided that:
They are placed in a secure closed-type transport cage.
The owner or keeper of the pet carries its personal health booklet.
The driver age limit must be from 23 to 75 years old.
The driver must hold a European or international driving licence.
The vehicle is prohibited from being used:
To leave the borders of Greece.
To transport persons or goods for hire or reward.
To tow or pull vehicles or other objects.
To be loaded onto a train, ship or other means of transport without the prior written consent of Key Cars.
To participate in or follow speed races.
For sub-rental or transfer to third parties.
For committing acts contrary to Greek laws.
When the Renter or additional driver of the vehicle is under the influence of alcohol, hallucinogens, narcotics, barbiturates or any other substance affecting driving ability and the senses.
To transport or move heavy luggage, flammable materials, polluting or foul-smelling objects, narcotics, etc.
Any repair of the vehicle by the Renter or any third party without the prior approval of Key Cars.
